Part A: General terms (apply to everything)

1. About these terms

1.1 These terms apply to all services and products purchased from Murf, including personal training sessions (one-off and ongoing), breathwork sessions, online coaching, digital products and courses, and group sessions and workshops.

1.2 By booking, purchasing or paying for any service or product, you agree to these terms.

1.3 Some programs, such as the Solid Start Plan, have their own written agreement. Where that agreement is different from these terms, the program agreement applies.

2. Payments

2.1 Prices are as listed on the website or agreed in writing at the time of purchase, and are in Australian dollars.

2.2 Payments are processed by third-party payment providers. Murf does not store your card details.

2.3 If a payment fails, it may be automatically retried. The timing and number of retries depend on the policies of the third-party payment provider used, and may differ between providers. You'll be notified and asked to update your payment details. Services may be paused until payment is up to date.

3. Health and safety

3.1 Before starting any service involving exercise or breathwork, you'll be asked to complete a health screening questionnaire. You agree to answer it honestly and to tell Murf about any changes to your health, injuries, medications or pregnancy.

3.2 Where needed, you may be asked to get medical clearance before starting or continuing.

3.3 Murf's services are not a substitute for medical, psychological or other professional treatment. If you have a health concern, please see your doctor or an appropriate health professional.

3.4 You take part voluntarily and understand that exercise and breathwork carry some risk of injury or discomfort. Let Murf know immediately if you feel unwell, dizzy or in pain.

3.5 Murf may modify, pause or decline a service if it isn't safe for you.

4. Refunds and your consumer rights

4.1 Refunds are not given for change of mind, or for sessions forfeited under the cancellation policies in these terms.

4.2 Nothing in these terms excludes, restricts or modifies your rights under the Australian Consumer Law. If a service isn't provided with due care and skill, or a product isn't as described, you may be entitled to a remedy.

5. Intellectual property

5.1 All programs, videos, worksheets, courses, recipes and other content provided by Murf are owned by Murf or used under licence.

5.2 You may use this content for your own personal use only. You may not copy, share, resell, publish or distribute it without written permission.

6. Photos, videos and testimonials

6.1 Murf will only use your photos, progress pictures, videos, name or testimonial in marketing with your written consent.

6.2 You can withdraw your consent at any time by letting Murf know. Content already published will be removed where reasonably possible.

7. Limitation of liability

7.1 To the extent permitted by law, Murf is not liable for any injury, loss or damage arising from your participation in services, except where caused by Murf's negligence.

7.2 To the extent permitted by law, Murf's total liability for any claim is limited to the amount you paid for the service or product concerned.

7.3 This clause does not limit any rights you have under the Australian Consumer Law.

8. Website information

8.1 Information on murf.com.au, including blogs, videos, calculators and free resources, is general information only. It is not personal medical, nutritional or psychological advice.

9. Privacy

9.1 Your personal and health information is handled in line with Murf's Privacy Policy at murf.com.au/privacy.

10. Changes to these terms

10.1 Murf may update these terms from time to time. The current version will always be available at murf.com.au/terms, and existing clients will be notified of any significant changes.

11. Governing law

11.1 These terms are governed by the laws of Queensland, Australia.

Part B: In-person personal training and breathwork sessions

12. Bookings and payment

12.1 Payment for each session is taken in the week before the session is held where possible, and always before the session takes place.

12.2 For ongoing sessions, whether you train once a fortnight, once a week or several times a week, payments are taken by direct debit on a regular billing cycle, in advance of your sessions.

12.3 Ongoing sessions are not a lock-in contract. You can cancel at any time by letting Murf know before your next payment is taken. Sessions already paid for are covered by the cancellation policy below.

13. Cancellations and rescheduling

13.1 48 hours or more notice: If you let Murf know at least 48 hours before your session, it will be rescheduled, or the payment will be credited to a future session, at no extra charge.

13.2 Less than 48 hours notice: Murf will do his best to fit you in at another time within the same week or billing cycle. If no suitable time is available in his schedule, the session will be forfeited and not refunded.

13.3 No-shows: Sessions missed without notice are forfeited.

13.4 Notice can be given by text or email. The 48 hours are counted from when your message is received.

13.5 Forfeited sessions cannot be carried over to a later week or cycle.

14. Late arrivals

14.1 Sessions start and finish at the scheduled time. If you arrive late, your session will still finish on time so the next client isn't affected.

14.2 If you are more than 15 minutes late without contacting Murf, the session may be treated as a no-show.

15. If Murf needs to cancel

15.1 If Murf needs to cancel or reschedule a session, you'll be offered another time. If no suitable time can be found, you'll receive a credit or refund for that session.

16. Breathwork safety

16.1 Breathwork is not suitable for everyone. You must let Murf know before booking if you are pregnant, or have epilepsy or a history of seizures, a heart or cardiovascular condition, high blood pressure, glaucoma, a detached retina, recent surgery, or a history of psychosis, bipolar disorder or severe mental health conditions.

16.2 Murf may modify or decline a breathwork session if it isn't safe for you.

Part C: Online coaching

17. What's included

17.1 Online coaching includes access to the coaching app, your personalised program, access to Murf's program library where included in your package, messaging support and regular check-ins, as described at the time of purchase.

18. Messaging and response times

18.1 Murf aims to reply to messages within 2 business days.

18.2 Messaging is not monitored around the clock and is not for urgent or emergency matters. If you need urgent medical or mental health help, contact your doctor, call 000 in an emergency, or call Lifeline on 13 11 14.

19. Billing and cancelling

19.1 Online coaching is billed in advance on a regular billing cycle, such as weekly, fortnightly or monthly, as chosen at the time of purchase. It is not a lock-in contract.

19.2 You can cancel at any time by letting Murf know before your next payment is taken. Your coaching continues until the end of the period you've paid for.

19.3 No refunds are given for partial periods.

20. Access after cancelling

20.1 Your access to the coaching app and programs continues until the end of your current paid billing cycle, and then ends. Please save anything you'd like to keep before then.

Part D: Digital products and courses

21. Access

21.1 Digital products and courses (for example, those delivered through Kajabi) are for the purchaser's personal use only.

21.2 Access to each course, including any support, community or Q&A that comes with it, is provided for the access period set out in that course's description at the time of purchase. When that period ends, course access and support end, unless you purchase an extension or ongoing coaching.

21.3 Logins must not be shared.

22. Refunds on digital products

22.1 Because digital content can't be returned, refunds are not given for change of mind once you've accessed the content.

22.2 If you haven't accessed the content, you can request a refund within 7 days of purchase.

22.3 If a product doesn't work or isn't as described, contact Murf and it will be fixed, replaced or refunded in line with the Australian Consumer Law.

23. Technical requirements

23.1 You're responsible for having a suitable device and internet connection to access digital products.

Part E: Group sessions and workshops

24. Bookings

24.1 Group sessions and workshops must be paid for in full at the time of booking.

24.2 Some group sessions need a minimum number of participants. If minimum numbers aren't reached, Murf may cancel or reschedule the session, and you'll be offered a transfer to another date or a full refund.

25. Cancellations and transfers

25.1 If you cancel at least 7 days before a workshop, you'll receive a credit for a future session or workshop.

25.2 With less than 7 days' notice, your place is non-refundable, but you can transfer it to someone else by letting Murf know before the session. The new participant must complete the health screening and agree to these terms.

26. Group respect and confidentiality

26.1 Group sessions work best when everyone feels safe. Please treat other participants with respect, and keep anything personal shared by others in the group confidential.

26.2 Murf may ask a participant to leave a session if their behaviour affects the safety or wellbeing of others. No refund applies in this case.
